Want to remove Existing cell tower on the land after I buy the property

I plan to buy the land which has an existing cell tower. The cell company may have an expired 5 year contract with the previous owner.

The cell company promises to remove the antenna tower after 90 days from the closing date by signing the Affidavit of Fact.

I plan to do some development on the land once I own the property so I want to remove the antenna tower.

Do I have a right to remove the existing cell tower on the land if the cell company does not remove the cell tower after 90 days?

The land is in Farmersville, TX.
