Cell tower access

by Jeremy
(Edna, KS)

My wife and I bought a home with a driveway that is used by cell phone companies and their service people to access those towers that are not on our property. The driveway is asphalt and the heavy trucks drive on it to access the towers which is degrading the driveway itself. Do we have any rights to compensation for this use? We live in Southeast KS and there are two towers being accessed by way of our paved driveway.

Easements?
by: Tower Genius

Did you read your easements before you bought the house? I think it's best to go to to property owner who is leasing to the tower companies or carriers and ask them to request that the wireless tenants repair the access road.

You can also call the tower companies or write them and make the request. You may be pleasantly surprised that they actually may want to fix your driveway.

Try the "honey" approach first before you try the "baseball bat" approach.
