cell tower lease and easement

My neighbor leases a piece of land to a cell tower conpany. There was not enough room on their land for an easement, so the previous owner offered enough easement for a road to reach the tower. He was compensated. The lease has expired and been renewed several times. When the lease is renewed the property owner is compensated for the lease and their portion of the easement. The cell tower company insisted that they do not owe me when they renew the lease. They actually renegotiated a new lease recently. I would like for them to compensate me for my easement. The trucks come and go all hours of the day and night. It is a private road and the trucks use excessive speed. I would like to deal with this issue also. Do I have options?

When you purchased the property was this easement disclosed to you? Did the cell tower company record it with the county so it showed up when your attorney pulled the title prior to the sale? If the answers are no.... give us a call and we can assist you.

If it was disclosed and it was a perpetual easement... they will not have to pay you any compensation.
