Power Transmission and Cell tower from Progress Energy

1. 2008 I purchased the property in Lutz, FL. On the property at the property border with next neighbor had a Power Transmission of Progress Energy (Duke Energy). On top of the tower is a cell antenna 91.4 meters. Cell antenna rent to Sprint, AT&T and Bright house etc.
2. I checked all public records related to this tower. Its own by Duke Energy. It build on the 100 Ft easement (50ft each site of two property). It had public record allowed them to carry the cell antenna since 1997. During that time the land was not development to housing subdivision.
3. The Avendale subdivisions in Lutz, FL build and finish 2005. The first owner has no paperwork or any acknowledges about the tower because the owner purchased for investment.
4. I contacted the progress Energy Real state officer and the officer indicated that no contract for this tower to any land owner.

I would like to find out my right on this issue.

I would hire a local counsel.

I would recommend that you hire a local land use attorney in your area and have them review the data you have acquired. Usually the carriers are pretty good at determining what they are allowed to do but they have made mistakes in the past.
