Why has a default matter dragged on for a year? I'm sure there has to be more to the story.

But if the tenant is truly in default based on your information, then call us here at Tower Genius immediately. Also if the lease is expired then it should be renegotiated or reinstated, or terminated to get their attention. You can adjust any provisions and with some luck improve the rent. Then sell it for a higher price.

Of course, if money is not an issue then just sell it now.

Expired lease with right of ROFR

Can a landowner sell the rental stream to third party when the tenant is default for more than 1 year with expired lease and there is right refusal clause and lease is still for negotiation because there is option to renew....

Frank, if you give a carrier or tower company the Right of First Refusal in the event that you want to sell the rental revenue stream of your cell site lease, who is going to compete for it in the open market?

The question is how much leverage do you have? Are you currently negotiating a cell tower lease and is the carrier using that as a bargaining chip? If you have a premium location and have the upper hand in the negotiation you should not give them the ROFR. If you have questions give us a call.
